Crores of pending cases, mounting vacancies, cases on the same issue being tried in different courts leading to different judgements and causing more confusion. The state of of the Indian Judiciary is not like a well managed organisation. The Chief Justice of India has asked as to why the letter of the Unnao Rape Victim was not produced before him, despite the Registry getting it on 17th July itself. Could the situation have been different had there ben a Court Manager?

 

The Minister of Law and Justice was asked the following questions in the Rajya Sabha on 25th July 2019-

(a) whether the Supreme Court has recently advocated for appointment of Court Managers to render assistance in performing the court administration;

(b) if so, the details thereof;

(c) whether Government has proposed any action plan in this regard and if so, the details thereof; and

(d) whether the Supreme Court has also advised all the State Governments to regulate the services of all Court Managers at the district level to ensure proper administration?

 

The Union Minister in his reply said-

“(a) The Hon’ble Supreme Court of India vide its Order dated 02.08.2018 in the matter of Interlocutory Application No. 279 of 2010 in Writ Petition (Civil) no. 1022 of 1989 impressed upon the State Governments that professionally qualified Court Managers preferably with MBA degree, must be appointed to render assistance in the performance of court administration. The said post of Court Managers must be created in each judicial district for assisting Principal District and Sessions Judges. The Apex Court in its order further mentioned that the services of any person already working as Court Manager in any district should be regularized by the State Government as their assistance is needed for a proper administrative set up in a Court. The above Order has been forwarded to all the State Governments/Union Territory Administrations and High Courts with the request that a report on the actions taken in this regard may be submitted to the Hon’ble Supreme Court.”
